Welcome to the WIGZ LAB website, wigzlab.com (the “Site” or “Platform”). The Platform is operated by WIGZ LAB (“we,” “us,” or “our”). Each person who accesses and/or uses the Platform (each a “User,” “you,” or “your”) should please read these Terms of Service (“Terms of Service”) carefully before using the Platform. By accessing or using the Platform, you signify that you have read, understand, and agree to be bound by these Terms of Service, regardless of whether you are a registered user. If you do not agree to these Terms of Service, please do not use the Site.

TO THE EXTENT PERMITTED BY LAW, BY USING THE SERVICE, YOU ARE AGREEING TO ARBITRATE DISPUTES AGAINST US IN YOUR INDIVIDUAL CAPACITY, AND YOU ARE WAIVING YOUR RIGHT TO ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. PLEASE READ THE DISPUTE RESOLUTION SECTION BELOW FOR ADDITIONAL INFORMATION.

These Terms of Service are effective as of the date posted above and we will not be bound by any additional or different terms or other documents that are inconsistent with these Terms of Service. We may modify or update these Terms of Service at any time by posting the amended terms on the Platform and such terms shall be effective for all uses of the Platform immediately once posted.

1. DESCRIPTION OF THE SERVICES

Subject to the terms and conditions specified herein, WIGZ LAB offers Users information regarding our high-end hair creations, HD Lace™ products, and accessories, and allows Users to purchase such products through the Platform. The Platform also allows Users to establish a customer account, submit inquiries, subscribe to our newsletter or SMS alerts, submit reviews, contact customer service, or otherwise interact with us (the “Services”). Certain of our Services require Users to provide personal information, as detailed in our Privacy Policy.

2. PERSONAL INFORMATION AND USER ACCOUNTS

Your use of the Services may require you to provide certain personal information, such as contact and payment information (collectively, “Customer Data”). Your submission of personal information to us is governed by our Privacy Policy.

By providing Customer Data, including as part of the account creation process, you agree:

To these Terms of Service and our Privacy Policy;
To provide true, accurate, current, and complete Customer Data;
To maintain and promptly update your Customer Data to keep it accurate and complete;
To maintain the confidentiality of your account credentials for security reasons;
To immediately notify WIGZ LAB of any unauthorized use of your account or any other breach of security; and
To take full responsibility for all activities that occur under your customer account.

WIGZ LAB is not responsible for any loss or damage arising from your failure to comply with these requirements. If you provide any information that is untrue, inaccurate, or incomplete, WIGZ LAB may suspend or terminate your account and refuse current or future use of the Services.

3. ELIGIBILITY

The Platform is intended solely for Users who can form legally binding contracts under applicable law and are of legal age of majority in their place of residence. By using the Services or the Platform, you represent and warrant that you meet these criteria and agree to abide by all terms set forth herein.

4. PROPRIETARY RIGHTS & INTELLECTUAL PROPERTY

As between you and us, WIGZ LAB owns, solely and exclusively, all rights, title, and interest in and to the Site, the Services, all content (including but not limited to all text, photographs, imagery, videos, product descriptions, designs, graphics, logos, HD Lace™ branding, and visual media), software, code, data, and the look and feel, design, and organization of the Platform (collectively, the “Site Content”).

Your use of the Platform does not grant you ownership of any Site Content.

Trademarks: The trademarks, logos, service marks, and trade dress displayed on the Platform (including WIGZ LAB and HD Lace™) are registered and unregistered trademarks of WIGZ LAB or third parties and may not be used without prior express written permission.
Limited License: We grant you a non-exclusive, non-transferable, limited license to access, view, and print portions of the Platform for the sole purpose of placing an order with us or using the Platform as a personal shopping resource. Any other use—including reproduction, modification, distribution, scraping, data mining, or republishing—is strictly prohibited without prior written consent.

5. PRODUCT INFORMATION, ORDERS & RETURNS

Product Accuracy & Colors

We strive to display our custom hair creations and lace details as accurately as possible. However, the exact color, texture, and appearance you see will depend on your monitor, lighting, and screen settings. Weights, lengths, and measurements are approximate and provided for convenience. We do not guarantee that your screen display of any color or texture will be 100% accurate.

Pricing & Availability Errors

We reserve the right to change or update information, including product pricing, descriptions, and specifications, and to correct errors or inaccuracies at any time without prior notice, including after an order has been submitted.

Order Acceptance & Limitations

We reserve the right to refuse service to anyone or cancel any order for any reason at any time. We further reserve the right to limit quantities purchased per person, per household, or per order (including orders sharing the same billing/shipping address or credit card). Reselling or distributing WIGZ LAB products without explicit written authorization is strictly prohibited.

Returns & EU/UK Right of Withdrawal

Products purchased are subject to our Refund & Return Policy.

Customers in the European Union and the United Kingdom retain their statutory right to withdraw from or cancel their purchase within thirty (30) days of receiving physical possession of the goods without giving any reason, in accordance with applicable consumer regulations.

6. CONTENT SUBMITTED BY USERS

By submitting any product reviews, photographs, testimonials, or comments (each a “Submission”) to WIGZ LAB, you certify that:

Your Submission consists of original material owned by you;
Your Submission does not violate third-party rights (copyright, trademark, privacy);
Your Submission is not defamatory, vulgar, threatening, or false.

By providing a Submission, you grant WIGZ LAB a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, display, edit, publish, and distribute your Submission across any media platforms (including our Website and marketing channels) without compensation or attribution.

7. PROHIBITED CONDUCT

You agree to use the Platform and Services only for lawful purposes. You agree NOT to:

Use the Platform in any manner that could damage, disable, or impair our servers or networks;
Attempt unauthorized access to accounts, computer systems, or networks;
Make purchases using fraudulent payment methods or stolen credentials;
Upload viruses, worms, Trojans, or destructive code;
Engage in web scraping, crawling, or automated data extraction without authorization;
Impersonate any person or entity, or falsify order details;
Use our content or products for commercial resale, distribution, or unauthorized commercial exploitation.

8. LINKED SITES & THIRD-PARTY SERVICES

The Platform may contain links to third-party websites or services (e.g., payment gateways like PayPal, Apple Pay, Klarna, or logistics tracking portals). WIGZ LAB does not endorse and is not responsible for the content, privacy policies, or practices of any third-party sites. Your interactions with third-party sites are governed solely by their respective terms.

9. DISCLAIMER OF WARRANTIES

THE PLATFORM AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WIGZ LAB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE PLATFORM.

10. LIMITATION OF LIABILITY

IN NO EVENT SHALL WIGZ LAB, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR PRODUCTS PURCHASED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIGZ LAB’S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO WIGZ LAB FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless WIGZ LAB and its parent, subsidiaries, affiliates, officers, directors, employees, and suppliers from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

Your use or misuse of the Platform;
Your breach of these Terms of Service or Privacy Policy;
Your violation of any law or third-party rights.

12. TERMINATION

We reserve the right, in our sole discretion, to suspend or terminate your customer account or restrict access to our Platform at any time, without prior notice or liability, if we believe you have violated these Terms of Service or engaged in fraudulent activity.

13. GOVERNING LAW & DISPUTE RESOLUTION

Pre-Arbitration Informal Resolution

In the event of any dispute or claim arising out of or relating to these Terms or your purchases, you agree to first contact us at legal@wigzlab.com with a description of the dispute and proposed resolution, attempting in good faith to resolve the matter informally for thirty (30) days.

Binding Arbitration & Class Action Waiver

If a dispute cannot be resolved informally, any legal dispute shall be settled through confidential, binding arbitration rather than in court, to the fullest extent permitted by applicable law.

YOU AND WIGZ LAB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

14. SEVERABILITY & MISCELLANEOUS

These Terms of Service, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and WIGZ LAB. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
